As part of the Eighty-Eighth Legislature, the Texas legislature passed House Bill No. 915 (“HB 915”), which created Chapter 104A of the Texas Labor Code (“Chapter 104A”), concerning the reporting of workplace violence. Chapter 104A requires all employers, regardless of size, to post a Notice to Employees of the Contact Information for Reporting Instances of Workplace Violence.
HB 915 went into effect on September 1, 2023, but provided the Texas Workforce Commission (“TWC”) until March 1, 2024 to adopt the form and content of the notice required by Chapter 104A. The TWC recently adopted and posted a copy of the notice (the “Notice”) to its website.
Effective immediately, all employers in Texas are required to post the Notice (1) in a conspicuous place in the employer’s place of business; (2) in sufficient locations to be convenient to all employees; and (3) in English and Spanish as appropriate.
